European Union Trade Mark Fees

Starting from March 23rd, 2016 the European Union Intellectual Property Office (EUIPO) (former Office for Harmonization in the Internal Market – OHIM) will introduce new fees for the filing of new European Union Trade Mark (EUTM) applications (former Community Trade Mark – CTM) as well as for the renewal of registered European Union Trade Marks.

According to Regulation (EU) No 2015/2424 of the European Parliament and the Council amending the Community trade mark regulation, a new a one-class-per-fee system has been set, replacing the current regime, which allows trade mark protection in three classes for a € 900,00 (electronic application) or € 1.050,00 (paper application) fee.

This means that applicants will pay a lower fee if they only apply for one class, the same actual fee if they apply for two classes, and a higher fee if they apply for three or more classes.

This new system will be tailor-made and benefit SMEs who will no longer be obliged to pay for classes of goods and services they do not need. It will render trade mark protection cheaper and more accessible, as it will result in a proportionate decrease of the application fees.

Moreover, the new fees structure will help to reduce the potential of congestion of the EU trade mark register by reducing broad claims for goods and services not really required by the trade mark owner, and ensure a more balanced and harmonious trade mark system overall.

Renewal fees are substantially reduced in all instances and set to the same level as application fees.

New fees have also been introduced with regard to opposition, cancellation and appeal fees.
